Top EU court adviser: Google Gemini’s use of news reports may infringe copyright
Advocate General Maciej Szpunar of the EU Court of Justice has opined that when a chatbot powered by a large language model takes a report from a news publisher’s site and uses it to generate an answer, it may in certain circumstances infringe the publisher’s rights, especially if it bypasses a paywall or reuses the specific expression of the report. He added that bare facts are not protected, and that training a large language model on copyrighted material is allowed under the existing text and data mining exception. The opinion is not binding, but if the court follows it, it could force tech giants to pay for news content and reshape how AI summaries affect traffic to publishers.
