US appeals court ejects judge from case over AI errors

The US Fifth Circuit Court of Appeals vacated a ruling blocking Mississippi's DEI ban in public schools and reassigned the case from district judge Henry Wingate to a different judge, finding his ruling contained AI-generated errors — fabricated names and nonexistent legal authorities. Wingate told Senator Grassley the errors stemmed from a law clerk's unvetted use of Perplexity. This is the first time a US federal appeals court has removed a judge from a case over AI use, signaling sharply falling tolerance for AI hallucinations in the judiciary.
